On 14 February 2020, despite the fact that there was no evidence, prisoner of conscience Fakhraddin Abbasov (Aboszoda) was sentenced by the Baku Court on Grave Crimes to 16 years of imprisonment. After the pronouncement of the judgement of conviction, the Talysh scholar, journalist and public figure continued to remain in custody in a pretrial detention facility of the State Security Service of Azerbaijan. However, according to unconfirmed information, on 12 March he was transferred to Pretrial Detention Facility No. 1 in Kurdakhani (Baku). At the same time, neither the family of Fakhraddin Abbasov (Aboszoda), nor his lawyer G. Ibrahimov, nor the Committee for the Defense of his rights were informed about this. Araz Abbasov, a brother of the prisoner, who made phone calls to the state authorities, received false information about the whereabouts of his relative, or they were not returned at all. Only on 1 April (i.e. 20 days later) he was informed that Fakhraddin Abbasov (Aboszoda) was transferred to another penitentiary institution. And it was not representatives of the relevant state authorities who informed him, but employees of the International Committee of the Red Cross, to whom he also applied for help. Up till now (36 days have already passed), the family of Fakhraddin Abbasov (Aboszoda) has not been able to come into contact with him. The head of Pretrial Detention Facility No. 1 refused his brother to both meet and have a telephone conversation with the prisoner. For over two weeks,the office of the Human Rights Commissioner (Ombudsman) and the Prison Service have been providing relatives with an obscure answer: “we are investigating”. According to the information provided to the ICRC by state authorities, the prosecutor (?!) prohibited Fakhraddin Abbasov (Aboszoda) to make any calls or come to any other contact with third parties. ICRC staff was denied any contact as well.
Such a long and persistent refusal by all state bodies to provide information on the whereabouts of prisoner of conscience Fakhraddin Abbasov (Aboszoda) and at least to have a telephone conversation with relatives causes concern about the health status of the 63-year-old Talysh scholar and journalist and creates the risk of unlawful physical and psychological pressure on him.
The Committee for the Defense of Rights of Fakhraddin Abbasov (Aboszoda) condemns any illegal prohibitions on telephone calls to relatives and lawyers imposed on the Talysh scholar and demands from the Prison Service of Azerbaijan, the Office of the Human Rights Commissioner (Ombudsman) of Azerbaijan, the administration of Pretrial Detention Facility No. 1 and the Prosecutor General’s Office of Azerbaijan to immediately provide reliable information about his whereabouts and state of health and to arrange a face-to-face meeting or at least a telephone conversation with relatives of Fakhraddin Abbasov(Aboszoda) and/or his lawyer.
The Committee for the Defense of Rights of Fakhraddin Abbasov (Aboszoda) calls on the Azerbaijani and international community to pay attention to the illegal pressure exerted on the elderly scholar and journalist and demand the provision of full and reliable information about his fate.
